Legal Newsletter 2019/1- Employment- related documents

A recent amendment of Act LXXXI of 1998 on Social Security Pension Benefits (hereinafter referred to as “SSPA”) entered into effect on 23 December of last year.

Pursuant to an important new provision of the above act, enterprises required to maintain social security records must retain all employment-related documents containing data on earnings and income that may be taken into consideration in determining the accumulated service time or the amount of pension benefits until five years after the employee concerned reaches the then prevailing age limit for old-age pension. Of course, this type of obligation does not apply to documents in the records of the employer for other, unrelated reasons, such as CVs/resumes, performance evaluations, training attendance sheets, etc.
